Specific risks of using services provided electronically include password theft, malware
and messages impersonating the Platform (phishing). Do not share your password and only
sign in through the App or at admin.naszcamp.pl.
5.Account
- You create an Account in the App or in the organizer panel by entering an e-mail address and password and confirming the address with a code sent by e-mail. On confirmation, a contract for maintaining the Account is concluded for an indefinite period.
- An Account may be created by an adult with full legal capacity. The data of a child enrolled in a camp is entered by their Guardian, who is responsible for its accuracy.
- An Account may also be created by an Organizer for a Participant or Guardian, or as an invitation for a member of the Organizer’s Team. Such an Account is activated by signing in with it, and from that moment these terms apply to it.
- You provide true information, protect your password from third parties and tell us without delay if you suspect unauthorized use of your Account.
- One person uses one Account. An Account may not be handed over to anyone else.
6.Camp enrollment and contracts with the Organizer
Who the camp contract is with
You conclude the contract for taking part in a camp with the Organizer,
not with the Provider. Naszcamp only provides a technical tool. The Organizer is
responsible for the camp programme, price, payment, cancellation and refund terms, and
for running the camp.
- Contracts, consents and camp rules are prepared by the Organizer. You read them before submitting an application.
- Documents can be signed in the App (a handwritten signature drawn on screen) or accepted by ticking a box, if the Organizer chose that mode. When a document is signed we record its content, its checksum, the time of the statement, the IP address and the browser or device identifier. A copy of each signed document is available in “My documents”.
- The Platform does not process payments and does not receive any money. You pay for the camp directly to the Organizer, for example by bank transfer to the account shown in the App. The Organizer records payments in the Platform.
- Cancelling a camp is governed by your contract with the Organizer. The App lets you withdraw from a camp (“Withdraw from camp”), which does not affect the rights and obligations under that contract.
- Complaints about a camp are addressed to the Organizer. We handle complaints about how the Platform works under section 10.
7.Rules of use and User Content
- You use the Platform in accordance with the law, good practice and these terms. You may not provide unlawful content, in particular content that infringes personal rights, copyright or other people’s privacy, offensive content, content inciting violence or hatred, or malware.
- Activities that disrupt the Platform, attempts to access other people’s data or Accounts, automated data harvesting and circumventing security measures are prohibited.
- When you publish photos or videos showing other people, in particular children, you are responsible for having a legal basis for it, including any required consents. The Organizer may set its own rules for publishing images at the camp.
- You keep the rights to your User Content. By adding it, you grant the Organizer and the Provider a free, non-exclusive licence to store and display it in the Platform to people with access to the given camp, solely to provide the services. The licence ends when the content is deleted, except for copies we must keep by law.
- Every post and comment on the timeline can be reported in the App. Reports go to the Organizer’s Team, who can hide the post. You can also report unlawful content to us at kontakt@naszcamp.pl, stating: the reasons, the exact location of the content (camp, post, date), your name and e-mail address, and a statement that the notice is made in good faith.
- Once we receive credible information that content is unlawful, we disable access to it without delay. We inform the person who reported it and the author of the decision, with the reasons. The author may appeal the decision through the complaint procedure in section 10.
- In the event of a serious or persistent breach of these terms we may, after first asking you to stop, block the Account. We may do so without prior notice where the safety of other Users or of the Platform, or the law, requires it.
8.Provisions for Organizers
- An Organizer sets up its organization in the admin.naszcamp.pl panel. The person registering it confirms that they are authorized to act on the Organizer’s behalf.
- Services for Organizers are paid according to the price list published at naszcamp.pl and the terms shown in the panel before purchase. Fees are prepaid per camp (camp credits). Invoices are issued electronically.
- For the data of participants, guardians and its Team, the Organizer is the data controller, and the Provider processes that data on its behalf under a data processing agreement. The Organizer is responsible for the legal basis of the processing and for informing participants and guardians.
- The Organizer is responsible for the content of contracts, consents and information published on the Platform, for running the camp, and for the actions of its Team, to whom it grants and revokes access.
- An organization must have at least one active administrator. The only administrator cannot delete their Account until they appoint a successor.
- Provisions on Consumers apply to an Organizer who is a natural person running a business only to the extent granted by law (Article 38a of the Polish Consumer Rights Act).
9.Account deletion and termination
- You may terminate the Account contract at any time, without giving a reason and free of charge, by deleting your Account in the App (Profile, “Account” section, “Delete account”) or by sending a request to kontakt@naszcamp.pl.
- Deleting an Account is irreversible. We delete your login details, the name in your profile, your profile photo and the notification tokens on your devices. The same e-mail address can later be used to create a new, empty Account.
- Deleting your Account does not cancel a camp. Applications, contracts, consents and payments stay with the Organizer, who is their controller and may contact you about the enrollment at the address given in the application. Your posts and comments on the camp timeline remain, but without your name and photo.
- A Consumer may withdraw from the Account contract within 14 days of concluding it without giving a reason. Deleting the Account or sending a statement to the e-mail address in section 1 is enough.
- We may terminate the Account contract with 30 days’ notice for important reasons, in particular the Platform ceasing to operate, or without notice in the cases described in section 7.7.
10.Complaints
- Complaints about how the Platform works can be sent by e-mail to kontakt@naszcamp.pl or in writing to the postal address in section 1.
- A complaint should include your contact details, a description of the problem and when it occurred, and, if possible, the camp name and the type of device.
- We handle complaints within 14 days of receipt and reply the same way the complaint was made, unless you ask for another channel.
11.Liability
- We make every effort to keep the Platform running without interruption. We may take it offline temporarily for maintenance, updates or to fix failures, giving Users advance notice where possible.
- We are not liable for running the camp, the content of the Organizer’s documents or settlements between you and the Organizer, as we are not a party to those contracts.
- We are not liable for User Content whose unlawful nature we were not aware of, provided that we disable access to it without delay after receiving credible information.
- Towards Organizers, our liability is limited to actual loss and to the amount of fees paid by the given Organizer in the 12 months before the event causing the damage. This limitation does not apply to damage caused intentionally.
- Nothing in these terms excludes or limits Consumers’ rights under mandatory provisions of law.
12.Personal data
How personal data is processed, including the different roles of the Provider and the
Organizer, is described in the Privacy policy.
13.Changes to these terms
- We may change these terms for important reasons, in particular changes in the law, changes in the scope or manner of providing the services, or security.
- We notify Users who have an Account by e-mail or in the App at least 14 days before a change takes effect. A User who does not accept the changes may delete their Account before then.
- Enrollments and contracts concluded before a change remain subject to the previous version of the terms, unless the change is more favourable to the User.
14.Final provisions
- These terms are governed by Polish law. This choice of law does not deprive a Consumer of the protection granted by mandatory provisions of the country of their habitual residence.
- Disputes with Consumers are settled by the courts competent under general rules. Disputes with Organizers who are businesses are settled by the court competent for the Provider’s registered office.
- A Consumer may use out-of-court complaint and redress procedures, in particular the help of a municipal or district consumer ombudsman or the provincial Trade Inspection. Information about these procedures is available at uokik.gov.pl.
- Use of the App downloaded from the App Store or Google Play is also subject to the terms of those stores. Apple and Google are not parties to these terms and are not responsible for the App or its support.
